Terms of Service

The agreement between us when you use this Website or book my services.

All policies

These terms apply between you, the User of this Website, and Julie Smith, the owner of this Website. They cover your use of the Website and the requests you make through it for my Services.

Whilst every effort has been made to keep these terms short and concise, I very much appreciate the time it will take for you to read through them! By using this Website you agree to these terms. Thank you.

1.Definitions and interpretation

In this terms of service policy, the following definitions are used:

  • Julie Smith, I or me: the owner of this Website;
  • Services: the in-home respite care and wellness support services I provide;
  • User or you: anyone who accesses the Website or requests my Services;
  • Website: the website that you are currently using, https://www.undertheyewtree.co.uk, and any sub-domains of this website.

In these terms, unless the context requires a different interpretation, the singular includes the plural and vice versa, the word “including” is understood to mean “including without limitation”, and the headings do not form part of these terms.

2.Using this Website

  1. You may use this Website for your own personal, non-commercial purposes.
  2. You must not use the Website in any way that is unlawful or fraudulent, that harms or attempts to harm the Website or its other Users, or that sends or uploads anything containing viruses or other harmful code.
  3. I try to keep the Website available and its content accurate and up to date, but I cannot promise that it will always be available, uninterrupted or free from errors.

3.Health information

  1. The articles and other content on this Website are general information about health, wellbeing and complementary therapies. They are not medical advice and are not a substitute for advice from your GP or another qualified healthcare professional.
  2. Always speak to your GP or a qualified healthcare professional before starting a new treatment or supplement, or if you have any concerns about your health or the health of someone you care for.
  3. In an emergency, call 999. For urgent medical advice that is not an emergency, call NHS 111.

4.Your account

  1. You may create an account to request bookings and comment on articles. The information you give me when you create an account must be accurate, and you must keep it up to date.
  2. You are responsible for keeping your password secure and for anything that happens through your account. If you think someone else has used your account, please contact me straight away.
  3. I may suspend or close an account that is used in breach of these terms.

5.Comments and content you post

  1. Please be kind and respectful when you comment. You must not post anything that is unlawful, abusive, misleading, or that infringes anyone else's rights, and you must not share other people's personal or medical information.
  2. By posting a comment, you allow me to display it on the Website. I may edit or remove any comment at my discretion.

6.Booking requests

  1. Requesting a booking through the Website is an enquiry. It is not a confirmed booking, and it does not commit either of us to anything.
  2. A booking is only confirmed when I confirm it with you directly. Before any care begins, we will agree the details together, including the dates, the support your loved one needs, my fees, and what happens if either of us needs to cancel or change the booking.
  3. Please give me accurate and complete information about the needs of the person I will be caring for, including any medical conditions, medication and mobility needs, so that I can care for them safely.

7.Products

  1. Products are shown on the Website for information. Adding a product to your basket does not place an order or take a payment. If you would like to buy a product, please contact me.
  2. Prices and availability may change. The price that applies is the one I confirm with you when you order.
  3. Supplements are not intended to diagnose, treat, cure or prevent any disease. Please check with your GP or pharmacist before taking a new supplement, especially if you are pregnant, breastfeeding, taking medication or have a medical condition.

8.Intellectual property

The content of this Website, including its text, images and logo, belongs to me or to the people who have allowed me to use it. You may view it, print it and share links to it for your own personal use, but you must not copy, reproduce or republish it for any other purpose without my permission.

9.Links to other websites

This Website may link to other websites that are not run by me. I have no control over those websites and I am not responsible for their content, or for any loss or damage that may arise from your use of them.

10.Limitation of liability

  1. Nothing in these terms limits or excludes my liability for death or personal injury caused by my negligence, for fraud, or for anything else that cannot be limited or excluded by law.
  2. Subject to the clause above, I am not liable for any loss or damage arising from your use of, or reliance on, the content of this Website.
  3. If you are a consumer, nothing in these terms affects your legal rights.

11.Your privacy

I only use your personal information as set out in my privacy policy, which also explains the cookies this Website uses.

12.General

  1. If any court or competent authority finds that any part of these terms is invalid, illegal or unenforceable, that part will be deemed to be deleted, and the rest of these terms will not be affected.
  2. Unless otherwise agreed, no delay, act or omission by either of us in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
  3. These terms are governed by the law of England and Wales, and any disputes arising under them will be subject to the exclusive jurisdiction of the English and Welsh courts.

13.Changes to these terms

I may change these terms from time to time. Any changes will be posted on this Website, with the date they were last updated shown at the top. If you have any questions about these terms, please contact me at julie@undertheyewtree.co.uk.
